A Bartow County judge has dismissed a 116-count indictment against a former assistant magistrate judge, saying the statute of limitations on the charges expired long before she was indicted in 2012.
Bartow Superior Court Judge G. Carey Nelson III dismissed the charges against Penny Blackmon—all related to alleged thefts of Bartow County magistrate court funds by a government employee between January 2003 and August 2005—in an order handed down April 8.
