Shiela Birnbaum may get a chance to show off as the newly-minted co-chief of the mass torts and product liability practice at Quinn Emanuel Urquhart & Sullivan. Or maybe not.

The opportunity comes courtesy of the U.S. Court of Appeals for the Second Circuit, which partly sided with Birnbaum Wednesday in a tobacco product liability case against Philip Morris but also certified a critical question to be decided by New York’s highest court. At this point, it’s not clear whether Birnbaum, her former partners at Skadden, Arps, Slate, Meagher & Flom, or someone else will be tapped for the job.
