The state Supreme Court has agreed to take a second look at a long-running battle between the DeKalb County district attorney’s office and the county’s magistrate judges.

The magistrates haven’t challenged the substance of last year’s state Court of Appeals ruling that said the judges must admit hearsay evidence in preliminary hearings in criminal cases. But two of the county’s magistrates have persuaded the state high court to consider whether the district attorney used an inappropriate procedure-a declaratory judgment action-to garner that ruling.
