SAN FRANCISCO — The Ninth Circuit U.S. Court of Appeals on Friday rejected class certification in a gender-discrimination suit against Costco Wholesale Corp. But the plaintiffs attorneys are calling it a victory.
A unanimous panel found that U.S. District Judge Marilyn Hall Patel used the wrong legal standard in analyzing “commonality,” and remanded the suit.
