Despite an attorney’s compliance with a new state requirement that lawyers verify information submitted in foreclosure documents, a Brooklyn judge has rejected a bank’s filings and an attorney affirmation after finding fault with underlying court papers.

Brooklyn Supreme Court Justice Arthur M. Schack (See Profile) in Washington Mutual Bank v. Phillip, 16359-2008, said the foreclosure documents were incomplete and he faulted the attorney’s affirmation for relying on a two-year-old conversation with a bank representative.
