Sales workers at NutriSystem Inc. failed to convince the 3rd Circuit to revive their overtime pay lawsuit despite U.S. Department of Labor support. In Parker v. NutriSystem Inc. , the 3rd Circuit voted 2-1 to uphold a lower court's ruling that the company's pay scheme qualifies for the "retail commission exception" in the Fair Labor Standards Act. The dissenting judge said he would have deferred to the Labor Department view that sales associates compared more directly to many other workers paid by commission because their wages are dependent on customers.

A group of sales workers at NutriSystem Inc. has failed to convince a federal appeals court to revive their lawsuit for overtime pay despite winning the support of the U.S. Department of Labor.
