As the recession grinds into its third year, the number of age bias suits is spiking in California. Few cases make it to a jury, and when they do, the awards have been modest. Employment lawyers say jurors -- many of whom have endured layoffs themselves -- aren't inclined to award large payouts to workers, older or not, who have been felled by reductions in force. Meanwhile, a recent California Supreme Court ruling may make it easier for older workers to survive summary judgment. But it's still a daunting obstacle.

William Dougherty spent 40 years servicing appliances for Sears Roebuck before being fired from the Concord, Calif., branch at the age of 64.
A Contra Costa County jury in April backed Dougherty in his age discrimination suit. But he didn’t get much: $67,000 in compensatory damages, nothing for emotional distress. And in July, the judge invalidated the verdict.
