Sometimes a letter can be deemed misleading just because it came from a lawyer. A Pennsylvania federal magistrate judge has ruled that lawyers who act as debt collectors cannot use their law firm letterhead for collection letters unless a lawyer has reviewed the file and the firm is truly poised to file a suit. The magistrate ruled that two letters from a New York lawyer violated the Fair Debt Collection Practices Act because the letterhead gave the false impression that a lawyer was working on the case and planning to sue.
