Longtime entertainment attorney James S. Mulholland and California state legislator Charles M. Calderon have created an alternative dispute resolution organization focused exclusively on the entertainment industry. The Entertainment Mediation Institute LLC (EMI), launched on Monday, will provide mediation services for the entertainment industry, including motion-picture, television, cable, music, sports, stage and literary companies. “We set up a private mediation organization that would be specific — the only one set up to handle entertainment matters,” Mulholland said. Most of the cases that EMI will handle could be resolved within a single day, said Mulholland, who has been a mediator for the Los Angeles County, Calif., Superior Court since 2002. Employment cases could prove one big source of business, he said; movie studios and production companies have been laying off workers lately. EMI also expects to handle traditional entertainment cases — disputes over literary option agreements and idea submission claims, or between agents and clients, managers and clients, or actors and studios. EMI will charge about $3,500 for a half-day’s services and $5,000 for a full day. The company has 12 mediators on staff, Mulholland said. Calderon has served in leadership positions in both the California Assembly and Senate and now sits on the Assembly Committee on Arts, Entertainment, Sports, Tourism & Internet Media. Calderon “called on me a number of different times when he had entertainment legislation pending in Sacramento, [Calif.,]” Mulholland said. Other members of EMI include: • Ron Mardigian, former senior vice president and head of the West Coast motion picture literary department at the William Morris Agency. • David Braun, an entertainment attorney whose clients have included Michael Jackson and Neil Diamond. • Irwin Russell, another entertainment attorney and longtime counsel to Michael Eisner, the former chief executive officer of The Walt Disney Co. • Claire L. Rothman, executive vice president of Ticketmaster Entertainment Inc. • Ralph Kamon, former corporate counsel to United Artists Corp., now part of Metro-Goldwyn-Mayer Inc.; and Paramount Pictures Corp., now part of Viacom Inc. • David Wardlow, a former talent agent who has represented Dustin Hoffman and Liza Minnelli. • Gregory Bernstein, former vice president of business affairs at Columbia Pictures, now part of Sony Pictures Entertainment Inc. • Fred Kuperberg, a retired executive vice president for business and legal affairs at Disney/ABC Cable Networks Group, part of The Walt Disney Co. • former California Senator Steve Peace, a motion picture and television producer. • John Schulman, former general counsel of Warner Bros., who leads the entertainment department at Mitchell, Silberberg & Knupp in Los Angeles. • Sports agent Ron Weinstein.
