In 2006, Michael Kaye, a reference librarian at the San Diego County Public Law Library, unloaded on his bosses in an e-mail blast sent out to the entire staff. Kaye was fired in August 2006 after a lengthy investigation, but he sued for wrongful termination, alleging in part that his free speech rights were violated. On Wednesday, a California appellate court upheld the dismissal of Kaye's case, noting, "A disgruntled employee's expression of dissatisfaction with his treatment on the job is not protected activity."
