Attorney fees and accounting costs may be included in a restitution order under the Mandatory Victims Restitution Act, the 2nd Circuit ruled Thursday in a case of first impression. The court rejected the argument that only those expenses specifically mentioned in the statute, or similar expenses, should qualify for restitution. The court upheld restitution of nearly $3.1 million in attorney fees and costs ordered against two defendants convicted of fraud, including a consulting firm's legal counsel.
