The Arizona Legislature still plans to use former Whitewater prosecutor Kenneth Starr for a U.S. Supreme Court appeal despite uncertainty about how much it will cost and where the money is coming from, a legislative spokesman said Friday.

House Speaker Jim Weiers had said Wednesday the matter was “up in the air” after the state Risk Management office said it would only pay Starr up to $335 an hour, the state government’s normal rate for outside lawyers on complex appellate cases. It’s a fraction of Starr’s $910-an-hour billing rate.
