Southern District of New York Judge Richard Sullivan, following a bench trial, rejected several claims by the New York-based jeweler and dealer in luxury goods, most importantly a claim that eBay was guilty of contributory trademark infringement because of its failure to aggressively pursue counterfeit sellers.
