An Ohio federal judge granted a specialty chemicals company’s motion to compel the production of documents from International Business Machine Corp. (IBM) in relation to its spoliation of evidence claim, compelling IBM to produce privileged documents.

In a recent ruling, U.S. Magistrate Judge Jennifer Dowdell Armstrong of the Northern District of Ohio, Eastern Division, granted The Lubrizol Corp.’s motion to compel the production of documents in support of its claims for spoliation of evidence against IBM, with Ohio being one of the few jurisdictions that permits parties to assert a cause of action for the tort of spoliation of evidence.
