The Oregon governor and the state’s director of Health Authority are immune from COVID-19 vaccination related claims under the Public Readiness and Emergency Preparedness Act, the U.S. Court of Appeals for the Ninth Circuit ruled.
The three-judge panel reversed an order denying dismissal of the suit against the state officials, concluding current and former Oregon inmates’ vaccine prioritization claims were barred under the PREP Act.
