A federal appeals court—for a second time—will take up certification of a class of Marriott International Inc. customers impacted by a 2018 data breach.

In a Jan. 18 order, the U.S. Court of Appeals for the Fourth Circuit granted Marriott’s petition for an interlocutory review of a Nov. 29 ruling granting class certification in the multidistrict litigation over the breach. U.S. District Judge John Preston Bailey’s “unprecedented” order, according to Marriott’s Dec. 13 petition, “defies both law and logic” and “threatens far-reaching consequences.”
