Grubhub has agreed to pay over $3.5 million to settle a lawsuit brought by the Massachusetts Attorney General’s Office accusing the food delivery service platform of overcharging restaurants fees for its services beyond the statutory 15% cap during the COVID-19 pandemic.

Last week, the parties in the case Commonwealth of Massachusetts v. Grubhub Holdings and Grubhub stipulated that they had reached a settlement ahead of a trial assignment conference scheduled at the end of the month. As part of the agreement, Grubhub will pay a combined total of over $3.5 million to impacted restaurants, as well as $125,000 to the commonwealth.
