The Court of Appeals for the state of Washington affirmed the dismissal of a lawsuit challenging eight Washington counties’ conduct in the 2020 general election, but the panel stopped short of awarding the counties attorney fees for the filings.

In the unanimous opinion, the appellate court said Washington state’s Lincoln and Franklin counties did not violate the Public Records Act in denying the Washington Election Integrity Coalition United’s multiple record requests for 2020 ballot records under the law’s “other statute” exemption.
