The Lummi Nation are not entitled to disputed waterways in Washington’s North Puget Sound based on a 1974 court decree, the U.S. Court of Appeals for the Ninth Circuit held Monday.

The appellate panel unanimously granted the Swimomish, Tulalip and Upper Skagit Indian tribal communities’ motion for summary judgment against the Lummi Tribe over a long-running case regarding Native American fishing rights in Washington state.
