A U.S. District Court judge in Connecticut denied a Kohl’s motion for summary judgment in a slip-and-fall case after concluding that a genuine issue of material fact remained regarding whether a defective condition existed, whether Kohl’s had constructive notice of this alleged condition, and if the department store failed to respond in a reasonable fashion.

In an Aug. 16 opinion, U.S. District Judge Stefan R. Underhill denied Kohl’s motion for summary judgment against Myrta Taylor, giving the parties 14 days to indicate whether they wish to refer the case to a magistrate for settlement purposes or want to proceed to a trial.
