Claims against a Virginia attorney alleging that he and his wife engaged in willful and wanton negligence, battery, assault and defamation against their neighbor and driver have survived a motion to dismiss in the U.S. District Court for the Eastern District of Virginia.

Virginia attorney Charles “Van” Hardenbaugh sought to dismiss claims filed by plaintiff Pamela K. Hartnett for assault and battery, defamation, negligence, willful and wanton negligence, trespassing and malicious prosecution stemming from an almost three-year feud with Hartnett, his neighbor in Petersburg, Virginia.
