The Vermont Supreme Court reinstated a defendant’s criminal conviction, finding the lower court erred in granting his motion to dismiss for a violation of his speedy trial rights after 45.5 months passed between his charging and his trial during the pandemic.

Associate Justice Harold E. Eaton Jr. authored the July 7 opinion, and was joined by Chief Justice Paul L. Reiber, Associate Justice Karen R. Carroll, Associate Justice William D. Cohen and Associate Justice Nancy J. Waples.
