A federal judge in Massachusetts has denied students’ motion seeking class certification against Brandeis University, finding the plaintiffs failed to determine the actual value of their online education during the spring 2020 semester after classes had moved online due to the COVID-19 pandemic.

Without taking that first step, there was no way for the plaintiffs to demonstrate liability and damages on a classwide damages model, Judge Nathaniel M. Gorton of the U.S. District Court for the District of Massachusetts held in an May 17 opinion.
