A federal judge in Massachusetts has denied the U.S. Immigration and Customs Enforcement’s renewed request for summary judgment, ordering the agency to provide additional information showing that it attempted to searched a former official’s phone in good faith.

The plaintiffs, the American Civil Liberties Union of Massachusetts and American Oversight, sought text and email communications from seven senior ICE officials stemming from an underlying criminal investigation of Newton District Judge Shelley M. Richmond Joseph and court officer Wesley MacGregor. Joseph and MacGregor were accused of scheming and allegedly allowing a defendant with an ICE detainer to exit the courthouse through a back exit to avoid arrest by an ICE officer waiting outside the courtroom.
