CANCEL CULTURE - The FTC last week proposed tweaking a 1970s-era rule to make it easier for customers to cancel subscriptions and memberships, a push that will force in-house counsel to freshly scrutinize renewal policies. FTC Chair Lina Khan said businesses employing subscription tricks and traps—including so-called “negative options,” where goods or services are sent to purchasers automatically unless they tell the seller that you do not want them—would be subject to stiff penalties. The FTC has been focusing recently on “dark patterns,” which are design tricks used on websites to confuse customers into purchasing products or making it hard to cancel subscriptions, Nerissa Coyle McGinn, a partner at Loeb & Loeb, told Law.com’s Chris O’Malley “Negative options are a form of dark patterns,” she added.
