A federal judge in Boston has denied what appears to be a fifth attempt by a veteran Boston trial lawyer to gain reinstatement to practice law in Massachusetts, though the previous four attempts were in state court, after he was suspended in 2016 and later found to have “open contempt for the legal system.”

Attorney Valeriano Diviacchi remains under suspension in the state of Massachusetts and may not practice in the U.S. District Court for Massachusetts, after he sought reinstatement in federal court even as his state court suspension was both ongoing and confirmed by the state’s Supreme Court in a December 2022 ruling.
