Consumer Class Action/Mass Tort Defense
Steptoe & Johnson partner Anthony G. Hopp has entered an appearance for CVS Health and CVS Pharmacy in a pending consumer class action. The suit, filed May 18 in New York Western District Court by the Schlanger Law Group and the Wilshire Law Firm, contends that CVS-brand hand sanitizer does not eliminate 99% of all germs as the marketing implies. Jenner & Block partner Elizabeth A. Edmondson and Squire Patton Boggs partner Adam R. Fox have stepped in as defense counsel for McDonald's and Wendy's, respectfully, in a false advertising class action. The suit, filed May 17 in New York Eastern District Court by James C. Kelly and other counsel, contends that the defendants cause their beef patties to appear 15 to 20 percent bigger in marketing images by not fully cooking them and loading them with extra toppings. Attorneys from O'Melveny & Myers have stepped in to represent Apple in a pending consumer privacy class action. The action was filed May 16 in California Northern District Court by Bursor & Fisher on behalf of video renters who accuse Apple of storing their rental histories, credit card numbers and other personal information in violation of the New York Video Consumer Privacy Act. Driscoll from Wilmer Cutler Pickering Hale and Dorr have stepped in to represent Symbotic Inc., an A.I.-enabled technology platform that focuses on increasing supply chain efficiency, and other defendants in a pending shareholder derivative lawsuit. The case, filed Oct. 2 in Massachusetts District Court by the Brown Law Firm on behalf of Stephen Austen, accuses certain officers and directors of misleading investors in regard to Symbotic's potential for margin growth by failing to disclose that the company was not equipped to timely deploy its systems or manage expenses through project delays. The complaint was filed Sept. 4 in Connecticut District Court by attorney Robert M.
