The U.S. Court of Appeals for the Ninth Circuit has reinstated a manicurist’s hostile work environment claim against Wynn Las Vegas resort, following several other circuits’ holdings that such a claim can stem from an employer’s response to unwanted sexual advances by a third party toward an employee.

The panel reversed the district court’s order granting summary judgment to Wynn on Vincent Fried’s claim of a hostile work environment in violation of his Title VII rights. Fried worked as a manicurist at the salon inside the hotel from April 2005 to July 2017.
