It’s not often that construction contract statutes are changed in Pennsylvania, so it was notable when Gov. Tom Wolf on July 12 signed legislation to amend the Contractor and Subcontractor Payment Act (CASPA). Effective on Oct. 10, these changes continue the push to alter the status quo in construction contracts and further protect builders seeking payments.

Importantly, the amendments create new obligations for parties that withhold payment, lay out a path for how contractors or subcontractors can suspend work without penalty if payments are not received and fortify CASPA against creative contract language.
