A new law on the books in New Jersey codifies, for the first time, rules, protections and best practices for all parties in a gestational surrogacy agreement.

In May, Gov. Phil Murphy signed the Gestational Carrier Act, which applies specifically to situations where the carrier has no genetic relationship to the child. The New Jersey State Bar Association (NJSBA) was an active supporter of the legislation. Instrumental to the effort was the testimony and work of Debra E. Guston, a partner at Guston & Guston in Glen Rock, member of the Family Law Section Executive Committee and former chair of the Lesbian Gay Bisexual Transgender (LGBT) Rights Section.
