In 2015, the public was shocked to hear that Volkswagen (VW) was intentionally cheating US automobile emissions testing. Two years later, in federal criminal court, VW was ordered to pay a $2.8 billion fine.

Now, private parties affected by this scandal want their payout as well. Most already have gotten theirs, but a few outstanding civil suits remain, specifically In Re: Volkswagen “Clean Diesel” involving Bosch, a software supplier whose technology was used to help VW evade emission tests. But before a civil judgement can be made in this case, the VW dealers who are suing Bosch must find common ground together for what is discoverable and what is not, which has proven to be difficult.
