In a highly anticipated decision following a May hearing, the U.S. Court of Appeals for the Third Circuit said in its opinion released Tuesday that transgender students in a Montgomery County school district may continue using bathrooms and locker rooms that match their gender identities.

The court’s ruling defeats a challenge raised by several parents who were concerned that Boyertown Area School District’s policy allowing transgender students to use facilities corresponding to their gender identity, rather than their sex at birth, violated their children’s right to privacy.
