The U.S. Court of Appeals for the Third Circuit has reinstated a doctor’s suit against a wound care clinic after finding the judge below misapplied New Jersey’s entire controversy doctrine.

The 2013 suit by podiatrist James Ricketti claimed his patients were being diverted by RestorixHealth, operator of the wound care center at Robert Wood Johnson University Hospital in Hamilton, N.J., according to the appeals court’s opinion. It followed another suit by Ricketti against a fellow physician that was based on the same set of facts.
