Former Philadelphia City Councilmember Bobby Henon, who was convicted on conspiracy and fraud charges, is asking the U.S. Court of Appeals for the Third Circuit to adopt a heightened evidentiary standard for elected officials charged with honest services fraud and either remand for his acquittal or grant him a new trial.

An appellate brief was filed on behalf of Henon by attorneys Bruce Merenstein, Robert Welsh Jr. and Richard Walk III, all of Welsh & Recker, claiming the U.S. District Court for the Eastern District of Pennsylvania hadn’t proven beyond a reasonable doubt that Henon had explicitly agreed to carry out specific official acts in exchange for compensation.
