The U.S. Court of Appeals for the D.C. Circuit on Friday upheld the four-year sentence of a Texas man who assaulted a police officer at the Jan. 6, 2021, riot outside the U.S. Capitol building.

Judges Patricia Millett, Gregory Katsas and J. Michelle Childs rejected Lucas Denney’s challenge to enhancements that were applied to his sentence for “more than minimal planning” and for use of “a dangerous weapon” during the attack. He was sentenced to 52 months in prison after he pleaded guilty to assaulting a federal officer with a PVC pipe.
