Obama and McCain Pick Their Least Favorite Supreme Court Justices

The Supreme Court, usually an also-ran as a presidential election issue, got some significant attention at the Rev. Rick Warren's televised Saddleback Civil Forum on Saturday night. Instead of asking Sen. Barack Obama and Sen. John McCain whom they would appoint to the high court, Warren asked both candidates which of the current justices they would not have appointed. Neither hesitated in giving an answer -- and Obama is already catching flak for his appraisal.

Last Term's High Court Rulings Mostly Pro-Corporation

In the 2007-08 term, the Supreme Court returned to areas of the law familiar to its tried-and-true business docket, addressing issues related to punitive damages, the scope of the civil provisions of RICO, pre-emption of state law and arbitration. Although the overall results were not as pro-business as those last term, the decisions again reflected an approach generally sympathetic to corporate concerns, say Kilpatrick Stockton's Adam H.
