A passion for helping others has always been the driving force behind the law firm of Elk & Elk Co., Ltd. For five decades, David and Arthur Elk have served Ohio injury victims in cases ranging from personal injury and medical malpractice to worker’s compensation and social security disability claims.
Never content to rest on its laurels, Elk & Elk has continued to expand its practice in reach and resources. Over the years, the firm has grown to encompass 19 attorneys, including three additional partners—John P. O’Neil, Phillip A. Kuri and James (Jay) M. Kelley—who each bring to the firm extensive defense experience.

While many cases are settled out of court, the attorneys at Elk & Elk are not afraid to take on big business and insurance companies in the courtroom. For example, in a recent wrongful death case, Kuri spearheaded an effort that resulted in a $39 million jury verdict on behalf of the widow of a construction worker who was killed on Interstate 271 near Richfield, Ohio. “When corporations place profits ahead of .safety, families suffer very real consequences,” says Kuri. “It is our wish that this verdict will put companies on notice and help prevent similar accidents in the future.”
Given the impact of their results, many of Elk & Elk’s attorneys have been recognized as leaders in their fields, with several attorneys named among Ohio’s top 100 attorneys by The National Trial Lawyers. In addition, seven lawyers have been rated AV Preeminent® by Martindale-Hubbell® and 11 have been listed as Ohio Super Lawyers or Rising Stars.
Still, O’Neil notes that Elk & Elk has never made achieving accolades a priority; instead, the firm’s main focus is on providing the highest quality service: “For us, the client comes first,” he says. “From multimillion-dollar medical malpractice cases to small personal injury claims, we help our clients navigate the morass of everyday problems. And at this firm, customer service doesn’t end with the client, it starts with the client; service is our foundation, so we’re constantly in the community giving back and finding ways to positively affect the lives of others.”
Elk & Elk has always been committed to not only serving the needs of injured victims in Ohio, but also giving back to the community in a variety of ways. The firm supports a wide range of organizations and programs, including St. Augustine Hunger Center, the American Cancer Society, Ronald McDonald House, the Spanish American Committee, Cleveland Rape Crisis Center and the Boys & Girls Clubs of Cleveland. Elk & Elk has also been a longtime safety advocate and proudly sponsors None 4 Under 21—an annual event for high school seniors that teaches about the serious consequences of drunk and distracted driving.
“We believe in helping families, building vibrant communities and making a positive difference where we work and live,” explains Kelley. “And through our efforts as trial lawyers, we have been able to create a meaningful charitable legacy.” Indeed, philanthropy has become so rooted in Elk & Elk’s culture that the firm’s partners—inspired by their employees’ commitment to giving back—have decided to make each donation go further: Last year, the firm implemented a matching gifts program that matches 100 percent of its employees’ charitable donations.
In its practice, the firm also works to better serve the families of Northeast Ohio by bringing added conveniences to its ever-expanding client base. For example, the firm recently opened its ninth Ohio office across from MetroHealth Hospital at 3350 W. 25th Street. “Our new West Side location makes us even more available to the victims of tragic accidents,” David Elk notes.
