(19 pp.) In these consolidated appeals, Bed Bath & Beyond appeals the final agency decision of the Treasury Department’s Unclaimed Property Administration that denied BB&B’s claim for a refund of the value of certain unclaimed merchandise return certificates, and in the second case BB&B appeals the UPA’s denial of a similar refund claim. In the first case, the court reversed the UPA’s denial because BB&B was not required by New Jersey’s Uniform Unclaimed Property Act, N.J.S.A. 46:30B-1 to -109, to remit these unclaimed certificates; and in the second case, the court reversed for other reasons, concluding that the certificates constituted “stored value cards” within the meaning of the UUPA, but that their value was remitted prematurely. 14-2-4340 J.S. v. N.J. State Parole Board, N.J. Super. App. Div. (Suter, J.A.D.) (09 pp.) Appellant is subject to community supervision for life (CSL) under the Violent Predator Incapacitation Act, N.J.S.A. 2C:43-6.4. His application to live in Sweden with his wife and children was summarily denied by the Parole Board, which treated it as a request to terminate CSL. The court reverses and remands to the Parole Board to consider the merits of appellant’s application, including whether the board could supervise or monitor his compliance with the conditions of CSL or impose special conditions.
