ESTATE OF ALEXANDER MALEH DEBUENOS, Deceased (07/915) — Lorna Houseman, voluntary administrator of the estate of Alexander Maleh DeBuenos, petitioned for discovery and turnover of property allegedly withheld from the estate by her brother, Jacques Elmaleh. Respondent filed an answer on September 25, 2007. The court held settlement discussions with the parties, the last of which occurred in December 2010. The proceeding has been inactive since that time. The pro se petitioner orally advised court personnel that she would discontinue the proceeding but has not done so, and the matter therefore remains open.

Unless one of the parties files a dispositive motion or a note of issue by June 30, 2017, the court, exercising its supervisory function, will dismiss the proceeding on the basis of unreasonable neglect (SCPA 209[8]; CPLR 3216).
