ESTATE OF VON SUNG YANG, Deceased (05/2685/A) — Before the court on March 3, 2017, was a motion to dismiss the petition to compel the co-Executors of the Will of Von Sung Yang and the fiduciary of a deceased co-Executor to account. At the call of the calendar, the court granted the motion to dismiss the petition to the extent that it sought to compel the respondents to account for their proceedings prior to January 1, 2013, because a release and waiver of account ("Release") was executed on May 23, 2013, by Russell Meraglio, Jr., Esq., Petitioner's predecessor (CPLR 3211 [a] , ).
