A Brooklyn appellate court has ruled that a trial judge was wrong to grant a new trial for a woman who challenged her conviction based on what she claimed was newly-discovered evidence of missteps at the then-shuttered Nassau County crime laboratory.

The Appellate Division, Second Department, unanimously reversed Acting Nassau County Supreme Court Justice George Peck’s March 2011 decision to grant a new trial to Erin Marino and instead reinstated the guilty verdict against her.
