U.S. District Judge Dale Fischer in Los Angeles on Nov. 30 issued a final judgment in the case, granting costs for Tropicana, which is owned by PepsiCo Inc., and nothing for Pom.

On Nov. 12, a federal jury found that Tropicana’s advertising and labeling of its Pure Pomegranate Blueberry juice drink did not deceive or mislead consumers into believing it was made from 100% pomegranate juice. Pom had argued that the Tropicana product, which contains mostly pear and apple juice, was confusingly similar to its own pomegranate juice drink.
