There are only a few weeks remaining to send in comments on the Chinese government’s new draft document, which attempts to clarify issues on cross-border data transfers. As it stands, companies may find regulations ensuing from the draft measures potentially cumbersome, particularly when it comes to transferring data outside the country.
Called The Draft Measures, the Measures on Security Assessment of Cross-Border Data Transfer of Personal Information and Important Data follows China’s far-reaching Cybersecurity Law (CSL), which was released last November and goes into effect on June 1. One of the key elements of the Draft Measures is that it expands the scope of data localization to cover network operators.
