Driver not liable for hitting pedestrians

On Jan. 14, a driver who struck two pedestrians at night wasn’t to blame for the collision, a jury found. Gragory Parker and Heather Cotton were walking in the road when they were struck by a station wagon driven by Sarah Cook. The defense noted that the plaintiffs were walking on the wrong side of the road and were wearing dark clothing. Also, the road was dark, with no lights. Cook said she tried unsuccessfully to stop before hitting the plaintiffs. The investigating officer noted under "factors and conditions" contributing to the accident that the plaintiffs failed to yield the right of way to the vehicle.
