Plaintiff recovers $779,400 for fall on deck
A vessel operator who fell while on the deck of a dredge tender recovered $779,400 on July 13. Hector De Leon claimed that the fall occurred because there wasn’t proper skid material on the deck. He claimed King Fisher Marine Service didn’t provide him enough opportunity and time to apply nonskid material. The defense argued that he was comparatively negligent because it’s his responsibility as a tender boat operator to keep it safe. The jury found that the defendant was 90 percent negligent and the plaintiff was 10 percent negligent, which reduced the $866,000 award.
