Doctor didn’t commit malpractice, jury finds

On June 27, a jury sided with a doctor who was sued for not removing kidney stones on the first of two surgeries. Dr. Juan Stern performed the procedures on Karen Housden. Defense counsel argued that Housden’s kidney was badly damaged and scarred due to an underlying medical condition, which prevented Stern from reaching and removing the stones on the first attempt. He was able to remove the stones about four months later. Plaintiff’s counsel argued that an X-ray should have been taken during the first procedure to locate the stones. But the jury apparently agreed with the defense’s radiology expert who argued an X-ray should not have been taken.
