County agrees to pay $115,000 to fired jail administrator

On Sept. 22, the Gray County jail administrator who was fired in the midst of her treatment for advanced cervical cancer agreed to a $115,000 settlement. In April 2010, Shelly McCarn was terminated. She had worked for the county for 15 years. About five months before her firing, she took time off to undergo a hysterectomy, which was when the cancer was discovered. McCarn claimed that she requested light duty or to work from home, but she was told to go home and get better. The county contended that McCarn was terminated because she exhausted her time under the Family Medical Leave Act. The defense argued that the only doctor’s note that she provided said she could not work at all until June 1, and she provided this note a week before her termination.
