MEDICAL MALPRACTICE

Doctor not liable for bowel perforation during surgery

On Aug. 19, a jury found a doctor wasn’t to blame for a bowel perforation that his patient sustained during a laparoscopic procedure. Ebony Davis underwent a bilateral tubal ligation that was performed by Dr. Daniel Mundy. Two days later she went to an emergency room, where she was found to be septic. She underwent immediate surgery to repair a pinpoint bowel perforation. She claimed Mundy never properly informed her of the risk of a bowel injury. Davis maintained that she was well informed of the risk, both orally and in writing. Defense counsel asserted that the bowel injury was not evident during surgery.
