Driver who ran over pedestrian not liable, jury finds

On May 11, a jury declined to award damages to a woman who was allegedly intoxicated when she was struck by a car and run over by another one. In 2009, Lisa Smith was struck by Elain Janvrin. Smith fell to the road and was run over by Janet Dewey. Smith claimed she was on the road’s shoulder when she was struck. Janvrin settled about a year before trial. Dewey argued that Smith wandered intoxicated into a lane of traffic. The parties disputed her blood alcohol level.
