Sometimes an interlocutory appeal is the surest way to avoid leaving an important issue to chance during litigation. And that’s how Jeff Hellberg characterizes his recent 4th Court of Appeals victory on behalf of two clients.

Hellberg, a partner in Dallas’ Wick Phillips Gould & Martin, represents two credit services organizations in NCP Finance Limited Partnership and NMCapital Inc. v. Humberto Escatiola. The April 27 decision concerns his clients’ appeal of a trial court order allowing an arbitrator to decide an issue of class certification.
